This document represents the entire memorialization of all warranties and terms in this contract.  No other conditions or guarantees are either expressed or implied.  Both Breeder and Buyer must initial any handwritten additions.

Breeder guarantees this animal to be in good health and of sound temperament.  The said dog may be returned to the Breeder within 48 hours of purchase for a full refund as long as the animal is in the same condition as when it left the Breeder.  Buyer agrees to take the puppy to his or her own veterinarian within 48 hours for a health check-up.  The Breeder shall not be responsible for the health, anatomical make-up and temperament of the aforementioned dog following this said period.

This agreement is subject to the terms stated in this contract, consisting of 3 pages.

CONDITIONS OF SALE

Breeder guarantees that the above-described dog is a purebred Rottweiler.  The dog is registered with the AKC (AMERICAN KENNEL CLUB).  A true copy of the pedigree has been given to the buyer.  The AKC papers will be handled as is written in this contract.  The dog will be registered with the prefix kennel name of Stoneridge or all warranties will become void.

Buyer agrees to have dog X-rayed at 24 months of age for hip and elbow dysplasia by a qualified Veterinarian.  X-ray is to be sent to OFA (Orthopedic Foundation for Animals) for evaluation.  Copies of the results are to be sent to Breeder.

Buyer accepts full responsibility for the health, proper care, the well being and behavior, of this Rottweiler.  Buyer absolves Breeder from any liabilities and/or damages by fault of this dog, including but not limited to destruction of property or physical damage to persons or animals.

Buyer agrees to take good and reasonable care of this dog; feed and house it properly, provide clean and sanitary surroundings, properly secure and control the dog in a fenced area, not tied up or allowed to run loose unattended for any reason.  Buyer agrees to provide regular training, socialization and veterinary care.  Buyer agrees to attend with the puppy, at least 3, six-week sessions of obedience classes before one year of age.

This dog will reside with the buyer at all times.  Buyer agrees to inform Breeder in writing of any change of address.  Buyer understands the concern of the Breeder for the proper placement of this dog into a responsible home.  Buyer agrees that neither ownership nor possession of this dog shall be transferred to anyone other than the Breeder.  Transfer of ownership or possession of this dog for more than 20 days shall be a violation of this agreement, subject to the stated damages.  If circumstances require that this dog can no longer remain in the possession of the buyer, it is agreed that the dog, including AKC Registration papers, will be returned to the Breeder at the Buyers expense.

Registration forms will be furnished upon receipt of payment in full, or as soon as they are received from the AKC.  The death or loss of this dog from any cause, before the final payment has been made, shall not release the Buyer from further payments.  The title of ownership and the right of registration shall remain with the Breeder until total purchase price has been made.

It is understood that this dog is being purchased as a potential Show and Breeding quality animal.  This dog does not possess any AKC disqualifying faults at this time.  Buyer agrees to earn an AKC Companion Dog title by 2 years of age.  Buyer agrees to seriously show and promote this dog to his fullest potential.

Buyer shall not permit this dog to breed until the dog has attained one of the following titles:  1) ZtP,      2) AKC Championship, or 3) AKC Utility Dog title.  The dog must also have been granted an OFA registry number stating the dog is free of Hip Dysplasia, an OFA Heart Certification, Eye CERF,                                        and a copy of the title earned and OFA report received by the Breeder.  There must be no disqualifying genetic or temperamental faults according to the current AKC standard for the breed.  Should this dog’s hips be unable to be certified by OFA, for genetic reasons, or this dog develops an AKC disqualifying fault by 24 months of age, the Buyer has the following options:  1) Breeder will refund the difference between pet and show price or 2) Breeder will replace the dog as soon as possible, with another show potential puppy at pet price.  In either case proof of sterilization must be furnished and the dog may be kept as a companion.

Buyer understands that Hip Dysplasia is not solely a hereditary problem.  With the utmost thought and care this puppy’s parents were chosen.  For many generations only breeding partners whose hips have been certified by OFA have been used, to insure that this puppy has a lower chance of having Hip Dysplasia.  Buyer agrees to do their part by not allowing this puppy during the growing stages to become overweight, to roughhouse with other dogs, to force exercise (such as jogging with owner) and to follow the recommendations of the Breeder.  If this dog develops a serious health problem that is solely hereditary by the age of 24 months that results in euthanasia, the Breeder will offer a replacement puppy from a future litter, subject to the terms of this agreement and availability.  Breeder is not responsible for any costs of care or treatment for this dog.

Buyer agrees to abide by the terms of this agreement, without exception unless changes are mutually agreed to in writing.  It is stipulated by and between the parties that failing to comply with the conditions of this agreement will result in the dog, the dog’s ownership and all AKC papers being returned permanently to the Breeder.  If any breeding, accidental or otherwise has taken place against the terms and/or conditions of this contract, this dog and AKC papers shall be immediately returned to the breeder without compensation due to the Buyer.  Buyer agrees that failure to comply with any of the terms in this agreement shall result in liquidated damages in the amount of $1000.00 per violation, without changing the terms of the agreement.  Buyer further agrees that any litigation rising from failure to comply shall take place in the area of residence of the Breeder, and the prevailing party shall recover reasonable attorney fees and court costs.

This agreement, consisting of 3 pages, is signed and dated by both parties.  Its major intent is assuring the well being of this dog, and it is in accordance with my/our understanding and I/we agree to the terms thereof.

I, the Breeder, certify that I am the owner of this dog and have good right to sell same.
